Client Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Payment Terms

Fees for services are outlined in your service agreement, proposal, invoice, or other applicable agreement.

Payments may be processed securely through third-party payment processors, including Stripe.

Recurring services are billed according to the agreed billing schedule. Failure to make required payments may result in suspension or termination of services.

All fees are non-refundable unless otherwise stated in a signed agreement or required by applicable law.

Service Term & Cancellation

Service terms, including monthly subscriptions, contracts, and project-based engagements, will be defined in the applicable client agreement.

Either party may cancel ongoing services according to the cancellation terms outlined in the applicable agreement.

Cancellation does not entitle clients to refunds for previously completed work, services already provided, or payments already processed unless otherwise agreed in writing.

Client Responsibilities

Clients agree to provide accurate business information, brand assets, access credentials, and any materials necessary for Aphex Growth to perform services.

Clients may be required to provide access to third-party platforms, including website domains, Google Business Profile accounts, social media accounts, or other business tools.

Clients are responsible for reviewing and approving content, campaigns, automated communications, and other materials before they are published or deployed.

Clients agree to use provided software, communication tools, and marketing systems in compliance with applicable laws and regulations, including SMS messaging regulations, TCPA requirements, and CAN-SPAM requirements.

Clients are responsible for obtaining proper consent from their own customers before sending marketing communications through any platform provided by Aphex Growth .

SMS Messaging Terms

By providing your phone number and opting in to receive SMS communications from Aphex Growth , you consent to receive text messages related to consultations, appointments, account updates, onboarding, customer support, and service-related communications.

Message frequency may vary.

You may opt out of SMS communications at any time by replying STOP to any message received from us.

Intellectual Property

Deliverables created by Aphex Growth , including websites, automations, campaigns, and other custom materials, become the property of the client upon full payment unless otherwise specified in a written agreement.

Aphex Growth retains the right to showcase completed work in its portfolio unless the client requests otherwise in writing.

Underlying software, templates, workflows, systems, frameworks, and platform infrastructure used to provide services remain the property of Aphex Growth or their respective owners and are licensed, not sold, unless otherwise stated in writing.

Third-Party Services

Our services may rely on third-party platforms and providers, including customer relationship management systems, marketing automation platforms, payment processors, email services, website hosting providers, analytics tools, and other technology providers.

Third-party platforms may experience outages, changes, limitations, pricing updates, or discontinued features.

Aphex Growth is not responsible for interruptions, errors, security issues, or changes caused by third-party providers.

Your use of third-party services may also be subject to the terms and policies of those providers.

Automated Systems & Technology

Some services provided by Aphex Growth may include automated workflows, communication systems, integrations, or artificial intelligence-powered tools.

Clients are responsible for reviewing and approving automated communications, workflows, and customer interactions before deployment.

Aphex Growth does not guarantee that automated systems will produce specific business outcomes, revenue increases, or lead generation results.

Limitation of Liability

To the fullest extent permitted by law, Aphex Growth is not liable for indirect, incidental, consequential, or special damages arising from the use of our services, including loss of revenue, data, business opportunities, or third-party service interruptions.

Our total liability for any claim related to our services is limited to the amount paid by the client for services during the preceding three (3) months.

No Guarantee of Results

While Aphex Growth works to provide effective digital solutions and growth strategies, we do not guarantee specific results, including lead volume, sales, revenue increases, customer acquisition, website rankings, or other business outcomes.

Results may vary depending on factors including market conditions, competition, business operations, pricing, customer demand, and client implementation.

Termination

We reserve the right to suspend or terminate services for clients who violate these Terms, fail to make required payments, misuse provided systems, engage in unlawful activity, or create risk to our business, platforms, or other users.

Termination does not remove any outstanding payment obligations or other responsibilities established under applicable agreements.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices, or legal requirements.

Any updates will be posted on this page with a revised effective date.

Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
